Terms and Conditions

The Promoter

These terms and conditions apply to the “TomTom Australia Cashback Promotion” offered by TomTom Sales B.V. (Australian Branch), a company whose principal place of business is located at Building 1, Level 5, 3 Richardson Place, North Ryde 2113 (“TomTom”).

The Promotion

  1. The “TomTom Australia Cash Back Promotion” (the “Promotion”) is open to all participants aged eighteen (18) years or over as of the date of purchase, and residing in Australia (the “Participating Country”) who purchase (i) a TomTom Spark or (ii) a TomTom Spark Music or (iii) a TomTom Spark Music + Bluetooth Headphones or (iv) a TomTom Spark Cardio or (v) a TomTom Spark Cardio + Music or (vi) a TomTom Spark Cardio + Music + Bluetooth Headphones or (vi) a TomTom Adventurer Cardio + Music (the “Promotional Product”), from eligible retailers between the 25th of March 2017 00:01 AM and the 2nd of July 2017 23:59 PM (the “Purchase Period”). The list of eligible retailers is located below in the Appendix. The Promotion is governed by these terms and conditions (“Terms and Conditions”).
  2. The amount of AUD$50 will be reimbursed for the TomTom Spark. The amount of AUD$60 will be reimbursedfor the TomTom Spark Music. The amount of AUD$60 will be reimbursed for the TomTom Spark Music +Bluetooth Headphones. The amount of AUD$75 will be reimbursed for the TomTom Spark Cardio. The amountof AUD$100 will be reimbursed for the TomTom Spark Cardio + Music. The amount of AUD$100 will bereimbursed for the TomTom Spark Cardio + Music + Bluetooth Headphones. The amount of AUD$100 will bereimbursed for the TomTom Adventurer Cardio + Music.

How to participate

  1. After purchase of the Promotional Product each participant (“Participant”) must complete his/her Promotionregistration claim on http://www.tomtom.com/cashbackau. Registration claims must be completed andsubmitted in full within thirty (30) calendar days of purchase of the Promotional Product (from the date on thepurchase receipt). A valid registration claim includes providing (i) personal contact details including a valid emailaddress, (ii) providing bank information, (iii) entering the barcode and serial number of the promotional product,and (iv) uploading a photo or scan of a valid receipt / proof of purchase of the Promotional Product, all withinthe Purchase Period.   2. Only new and original Promotional Products qualify for participation in the Promotion. Second hand, refurbishedor reconditioned products are excluded. Additionally, purchases from eBay or third party resellers on Amazonare excluded from the Promotion.
  3. Upon submission and acceptance of a registration claim, Participant will receive a registration claimconfirmation via email which will include a unique reference number. This number must be included in allcommunications related to the Promotion.
  4. Once the registration claim has been verified by TomTom, the reimbursement amount (the “Premium”) will betransferred within 30 days into the bank account provided by Participant. The bank account must be in the samecountry as the Participant’s residence and the Promotional Product must have been purchased in the samecountry.
  5. All incomplete or invalid registration claims will be automatically rejected and the Participant will receive arejection notification by e-mail. Rejected registration claims must be corrected and resubmitted by Participantwithin 7 business days after notification to be eligible for reconsideration. A registration claim is consideredincomplete or invalid if it matches one or more of the following criteria (including but not limited to):
  • Promotional Product not purchased;
  • Promotional Product purchased outside of Purchase Period;
  • Registration completed after stated deadline;
  • Promotional Product not purchased from an eligible retailer;
  • Promotional Product was returned;
  • Any required information missing on the registration form;
  • Invalid or no proof of purchase supplied;
  • Invalid photo / copy of receipt;
  • Invalid or no barcode supplied;
  • Invalid or no serial number supplied;
  • Incomplete or insufficient bank details supplied;
  • Participant does not reside within a Participating Country;
  • More than one Premium claimed per person

8. Participant must abide to the process illustrated within these Terms and Conditions, including the specifieddeadlines and requirements for the Promotion. Participants must complete valid registration claim within thirty(30) calendar days of purchase of the Promotional Product (from the date on the purchase receipt).

9. If the Promotional Product is returned/exchanged after the Premium has been deposited into the Participant’sbank account, the Participant’s claim is invalidated and the Participant shall refund any Premium(s) to TomTomwithout undue delay.


    1. The Promotion is open to Participants aged 18 years of or older as of the date of purchase. Wholesalers andretailers selling any TomTom products, employees and contractors or their families of TomTom or its affiliatedcompanies, TomTom's agents and anyone involved in the organization or administration of the Promotion areexcluded from participation. The Promotion is valid only for a new Promotional Product in its original packagingpurchased from a participating retailer, to be determined at TomTom’s sole discretion. All Promotional Productspurchased at a non-participating retailer, for example not limited to resellers at other suppliers (e.g. eBay,Amazon etc.) are excluded from the Promotion.
    2. Participant must abide to the process illustrated within these Terms and Conditions, including the all specifieddeadlines and requirements. The last date to register online is before 23:59 on the 1st of August 2017, 30 calendar days after the final day of the Purchase Period (“Completion Date”) and must be within 30 calendar days of purchase of the Promotional Product.
    3. Maximum of one (1) Premium claimed per person.
    4. TomTom withholds the right to investigate a case where fraud is suspected and in case of a fraud, to collect damages from the individuals concerned.
    5. TomTom respects Participants’ privacy and sees to it that all personal data will be processed in accordance with TomTom’s privacy policy. Details can be found by visiting www.tomtom.com/legal/privacy/
      TomTom may hand the personal data to a professional third party appointed by TomTom if this is necessary for administration of the Promotion. TomTom and its agents are responsible for storing, processing and transferring the personal data and, if needed, for obtaining Participant’s consent. TomTom adheres to European Union and other local privacy laws. Based on this, TomTom will only use your information for the purposes and duration for which it was obtained. TomTom will protect your information against misuse.     6. TomTom accepts no responsibility or liability for lost, late, damaged or misdirected registration claims. TomTom is not responsible for any late or misdirected delivery of the Premium.
    7. TomTom reserves the right to unilaterally withdraw, amend, supplement, and/or change this Promotion and/or the Terms and Conditions at any time and without prior notice to Participant. The Premium is non-transferable and no other alternative is available. The Promotion cannot be combined with other promotions, discounts or offers.

If any provision, or part of a provision, of this Promotion or these Terms and Conditions, is found by any court or authority of a competent jurisdiction to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of this Promotion or these Terms and Conditions, and the legality, validity or enforceability of the remainder of the provisions of this Promotion or these Terms and Conditions shall not be affected, unless otherwise required by operation of applicable law.
    10. TomTom excludes its liability to the extent permitted by law. However, nothing in this Promotion or these Terms and Conditions will operate so as to exclude or limit TomTom’s liability for death or personal injury arising out of negligence, or for any other liability which cannot be excluded or limited by law.
    11. The failure to exercise, or delay in exercising, a right, power or remedy provided by this Promotion or these Terms and Conditions or by law shall not constitute a waiver of that right, power or remedy. If TomTom waives a breach of any provision of these Terms and Conditions, this will not operate as a waiver of a subsequent breach of that provision, or as a waiver of a breach of any other provision.
    12. TomTom may, without notice and without the consent of Participants, assign any of its rights relating to its operation of the Promotion or delegate any of its duties relating to its fulfillment of the Promotion under these Terms and Conditions, if such assignment or delegation is to (i) an affiliate of TomTom; (ii) a successor of TomTom, by consolidation, merger or operation of law; or (iii) a purchaser of all or substantially all of TomTom's assets.
    13. Local law is applicable to this Promotion.
